AI-Created Ornaments Spark Copyright Concerns

A new set of AI-generated Christmas ornaments has captured public attention. These ornaments feature a variety of copyrighted characters, including Disney's Beauty and the Beast, Jack and Sally from The Nightmare Before Christmas, The Grinch, Shrek, and Chucky and Tiffany from Child's Play, depicted in controversial poses. Some versions are even animated using AI technology.

While these ornaments may evoke laughter, the use of cartoon characters in such a manner may seem peculiar. In certain cases, AI-generated female characters have been added to complete the designs. Not all ornaments are controversial; some possess a certain charm, like the Cinderella Castle ornament from Walt Disney World, which allows for the addition of family member names.

Despite their charm or humor, these ornaments are likely to face significant copyright issues. Their design closely resembles officially licensed character ornaments found in Hallmark stores, and copyright holders may not approve of this usage. If Mickey and Minnie from Steamboat Willie were used, they would be free from copyright concerns.

There might be a claim for fair use as parody, but the company is selling these ornaments to the public, which could lead to legal challenges. With some TikTok videos garnering hundreds of thousands of views, and the Grinch ornament receiving over 1.5 million views, legal action seems probable.
